Joseph Stembridge's blog ::Independent U.S. Contract Lawyer Takes On Foreign LPO: Round 2
Mother knows best. Syosset, L.I., criminal attorney Gary Schoer, who defended La Cosa Nostra soldier Jerry Balzano after his client's 2011 indictment in a federal mob crackdown, says that the family of a Long Island doctor who is being sued by her ex-boyfriend has retained him to represent them. Schoer was contacted by the doctor's mother after she and her husband were added as defendants in the federal lawsuit. Charges filed by the ex-boyfriend against the doctor and her family include counts for Fraud, Abuse of Process and Unjust Enrichment. The doctor initially ignored the legal papers. She appeared to be planning not to fight her ex-boyfriend's lawsuit until her mother stepped in. Schoer the Shark Schoer is a familiar presence in the federal district court in Central Islip. He represented defendant Jerry Balzano in 2011 after a massive, widely reported FBI Mob crackdown. Balzano was one of 127 members and associates of The Mob facing counts ranging from possession of contraband cigarettes to murder, extortion and loan sharking. Balzano was allegedly a soldier in the DeCavalcante crime family, on which "The Sopranos" HBO television series was based. Other past Schoer clients include a drug dealer caught in a DEA undercover sting and an investment banker who was caught hiding income from billions of dollars in capital he raised in Russia. He was trying to reduce a $400,000 judgment for child support payments. Schoer also represented drug dealer Pedro Enrique Perez-Rodriguez and the younger brother of a disbarred Queens lawyer, Gary Friedman, to reduce his sentence in a case involving extortion, loan sharking, kidnapping, illegal drugs and murder. Revenge was Sweet The doctor named in the verified Complaint, which was filed last December, had not responded after the legal papers were served in February. Defendants get 21 days to answer a legal Complaint. But after her mother and father were added to the lawsuit, they engaged Schoer, a Long Island native and 1975 graduate of St. Louis University Law School in Missouri. Schoer notified the federal court in Central Islip on March 27 that he would represent "Dr. Jane Roe" and her parents, "G.C." and "I.S." Their identities were redacted from legal papers following a December ruling by federal Judge Joseph Bianco that allows use of the doctor's applications as exhibits to the complaint. The civil lawsuit was filed by the doctor's ex-boyfriend, plaintiff Ahdy Attallah, a physician from Egypt who enrolled in medical school here so that he could practice in the U.S. Attallah believes the whole mess boiled down to one thing: Revenge. He didn't want to marry her. He is suing over damages involving his medical school, the New York College of Osteopathic Medicine in Old Westbury, N.Y., following a complaint accusing him of violating his ex-girlfriend's order of protection and stalking her. He said, she said The unidentified girlfriend was working at the time as a medical resident at Nassau University Medical Center in East Meadow, N.Y., when she and her parents approached hospital officials with the rumor that got him expelled. NYCOM acted a few days after receiving the complaint from the hospital. Attallah says he gave Dean Thomas Scandalis a copy of the doctor's rejected Connecticut application to prove he was innocent. But they expelled him anyway. Now he wants to prove, beyond a shadow of a doubt, that his ex-girlfriend and her parents lied to everyone. He says no one at NUMC or NYCOM bothered to check her story. If they had, he says, they would have quickly discovered that she never obtained an order of protection, was never poisoned, and was lying about being stalked. He adds that they should have been suspicious because of the woman's sketchy work history, her credit rating, and her questionable academic record. Hospital, College Co-Defendants NYCOM and NUMC are also listed as defendants in his lawsuit. NYCOM has engaged Fulbright & Jaworski, the famous New York legal powerhouse of Watergate prosecutor Leon Jaworski, to defend it against Breach of Contract and several civil rights claims. Former Nixon Peabody associate Amy L. Ventry-Kagan, now a partner at the Melville, N.Y. firm Littler Mendelson, represents NUMC, the hospital where the doctor worked. Ventry-Kagan has devoted much of her career to representing large corporations and financial institutions. She attended Barnard College and Temple University School of Law. Not much is yet known why a frazzled Hospital official contacted NYCOM instead of its security department. Attallah points out that most people would contact police to complain about a stalker. ## |
